Thomas Codner Agent for pltiffs. pray Judgment and execution on defts. effects, stating that deft. was possessed of a House and Gardens at Renewse, and that the same be sold for payment of the said debt ~ denis McCarthy of Renewse having claim to the said premises—proceedings was defered untill dennis McCarthy shoud appear to prove his claim ~

The deceased was drowned in June 1818, was adealer of ptiffs and died possessed of a House and Garden which he possessed of by marriage, with the Widdow of John doyle-

The deceased's Widdow objected that the said premises were the property of her former Husband who died intestate, leaving a child—which child she contended had a right to enjoy all her deceased fathers property ~

Judgmt. that the property in question, being considered from the circumstances of doyle's dying intestate, to belong, one third to the Widdow and two thirds to the children—That the Widdow's one third, as becoming the property of her second Husband thro marriage, is subject and liable to pay his debts—the other two thirds to remain for the Children.
